1. About these Terms
These Terms & Conditions ("Terms") are a legal agreement between you and StreamerControl ("StreamerControl", "we", "us", "our"), and govern your access to and use of the StreamerControl desktop application, websites, overlays and related services (together, the "Service"). By downloading, installing, accessing or using the Service, or by purchasing a subscription, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. The Service is intended for adults and may be used to control electro-stimulation devices. By using the Service you represent and warrant that you meet these requirements.
3. The Service
StreamerControl connects to TikTok LIVE and lets you map events (such as gifts, likes and chat) to actions, including operating compatible PiShock devices, displaying OBS overlays, and playing sounds. Features available to you depend on your plan (see Pricing).
The Service depends on third-party platforms and may change, be interrupted, or stop working if those platforms change. We do not guarantee that the Service, or any particular feature, will always be available, uninterrupted or error-free.
4. Accounts & licensing
Some features require you to link a Discord account. Your access tier is determined by your role in our Discord community and verified by our licensing service. You are responsible for keeping your account secure and for all activity under it. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms and your plan. You must not share, resell or sublicense your access.
5. Acceptable use
You agree not to:
- use the Service for any unlawful, harmful, harassing, or non-consensual purpose;
- operate a device on any person who has not freely given informed consent, or who is not an adult;
- breach the terms of TikTok, PiShock, Discord, or any other platform you connect through the Service;
- reverse engineer, tamper with, circumvent licensing, or attempt to access features outside your plan;
- use the Service to infringe others' rights or to transmit malware or abusive content; or
- resell, redistribute or commercially exploit the Service without our written permission.
6. Device safety & assumption of risk
StreamerControl is software only. We do not manufacture, sell, or supply PiShock or any electro-stimulation device, and we are not responsible for those devices or their behaviour. Electro-stimulation carries inherent risks. You acknowledge and agree that:
- you use such devices entirely at your own risk, and you are solely responsible for their safe setup, placement, intensity limits, duration limits and supervision;
- you will follow the device manufacturer's safety instructions and warnings at all times;
- devices must never be used by, or placed on, anyone with a heart condition, pacemaker or other implanted electronic device, epilepsy, who is pregnant, or who has any condition that could be aggravated by electro-stimulation, and never across the chest/heart, head, neck or other unsafe placements;
- you are responsible for obtaining the informed, voluntary consent of any adult on whom a device is used, and for configuring safety caps (maximum intensity and duration) appropriately; and
- because the Service can be triggered by public, unpredictable input from TikTok viewers, you accept the risks this creates and remain responsible for setting safe limits and for stopping activity (including via the panic hotkey) at any time.
To the maximum extent permitted by law, we are not liable for any injury, harm, loss or damage arising from the use or misuse of any device controlled through the Service.
7. Third-party services
The Service interoperates with third-party products and platforms, including TikTok, PiShock, Discord, EulerStream and OBS. We are not affiliated with, endorsed by, or sponsored by any of them. Your use of those products is subject to their own terms and policies, and they may change or discontinue access at any time, which may affect the Service. We are not responsible for third-party products or their availability.
8. Payments, renewals & cancellation
Paid plans are sold and billed through our third-party membership platform, Patreon, under their own terms. Prices are in Australian dollars and include GST where applicable. By subscribing, you authorise recurring charges for the plan and billing period you select until you cancel. Memberships renew automatically at the then-current price unless cancelled before the renewal date. You can cancel at any time in Patreon; cancellation takes effect at the end of your current billing period, and you retain access until then. We may change prices on a prospective basis with reasonable notice.
9. Refunds & consumer guarantees
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods or services repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Except as required by law (including the Australian Consumer Law), payments are non-refundable, and we do not provide refunds for change of mind or for time remaining on a billing period after cancellation. To request a refund you believe you are entitled to, contact us via our Discord community.
10. Intellectual property
The Service, including its software, branding, logos and content, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer any ownership to you. You retain ownership of content and configurations you create.
11. Disclaimers
To the maximum extent permitted by law, and subject to section 9, the Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, secure, error-free, or that it will meet your requirements or work with any particular device, platform or configuration.
12. Limitation of liability
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot be excluded. Subject to that:
- to the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, data, goodwill, or for personal injury or property damage arising from device use, however caused; and
- where our liability can be limited (but not excluded), our total aggregate liability to you for all claims is limited, at our option, to re-supplying the Service or paying the cost of re-supply, or to the total amount you paid us for the Service in the 3 months before the event giving rise to the claim, whichever is greater.
13. Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from claims, liabilities, damages, losses and expenses (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Service or any device, or your violation of any law or third-party rights.
14. Suspension & termination
We may suspend or terminate your access to the Service at any time if you breach these Terms, if required to protect the Service or others, or if a third-party platform requires it. You may stop using the Service and cancel any subscription at any time. Sections that by their nature should survive termination (including 6, 9–13) will survive.
15. Changes
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by posting the updated Terms with a new effective date). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
16. Governing law
These Terms are governed by the laws of Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Australia.
